Douglas A. Milch, attorney at WRSMH, recently obtained a $3.1 million settlement on behalf of a 62-year-old baggage handler who injured his cervical spine in a tarmac accident at the airport when his baggage truck was struck by a taxiing airplane.

Douglas was able to settle the case after establishing the airplane at issue negligently struck the plaintiff’s legally parked vehicle after: (1) the plane exited its proper runway area while making too wide of a turn and (2) marshal evidence that the plaintiff’s cargo truck was legally parked within its designated safety zone. The plane had struck the plaintiff’s vehicle with sufficient force to flip the cab over, which required the plaintiff to undergo cervical fusion surgery.
