Robert J. Bellinson, Of Counsel at Wingate, Russotti, Shapiro, Moses & Halperin, LLP, recently settled a case during trial against a property owner for $850,000. On the day the trial started there was no offer, but by the end of the presentation of evidence, the case settled for $850,000.
Rob’s client was a 68-year-old man who sustained a right knee injury on January 2, 2013, when he fell on debris that the building’s superintendent had left on the staircase that the plaintiff used to enter his home.
The attorneys who previously handled this case retained an engineer who detailed the dangerous conditions, as well as multiple building code violations that were allowed to exist for some time. The defense at trial sought to highlight the plaintiff’s age and pre-existing arthritis as the principal reason for the three surgeries that the plaintiff had to endure.
However, Rob’s meticulous presentation of medical evidence, medical illustrations, and expert medical testimony covering how a traumatic knee injury can result in changes the weight distribution and manner of walking, Rob was able to secure a sizeable recovery that his client says has changed his life.
