WRSMH attorney Konstantin Burshteyn secured a $1,500,000 settlement for a 64-year-old woman who injured her knees and neck in a motor vehicle accident in New York City.

Our client was a passenger in a vehicle when it was involved in a sideswipe collision. Our client refused medical treatment at the scene of the accident and began treatment more than a week after the crash. As a result of the accident, she was required to undergo two arthroscopic surgeries and a single-level cervical fusion.

Defendants argued that the impact was minor and resulted in minimal property damage, that the client’s injuries were caused by natural bodily deterioration and the surgeries addressed the client’s preexisting conditions, including those related to a prior accident.

Konstantin was able to obtain summary judgement on liability, finding both defendants at fault and preparing the case for trial.

The case settled at a private mediation as the parties waited for a trial date.
