Restaurant Negligence
The infant plaintiff, age 6 at the time, and his mother were patrons in defendant's coffee shop. The infant used a restroom and when he came out, a bus boy carrying a pot containing 50 pounds of boiling potatoes bumped into him, splashing his back with boiling water. The bus boy was bringing the pot from one kitchen to another kitchen where the potatoes were to be prepared. We proved that the restaurant was negligent in using two different kitchens to cook food and that the bus boy was negligent in failing to look where he was going. The infant sustained second degree burns on the back of his left shoulder with permanent discoloration and second degree burns to his arm with raised scarring.
