Car Accident - Red Light Auto Accident
WRSMH Of Counsel, Brielle C. Goldfaden, negotiated a settlement for the full liability policy limits, $250,000, on behalf of our 35 year old client. Our client was driving his car along Avenue Y in Brooklyn when he stopped for traffic at a red light. The driver behind him did not stop and crashed into the rear of his car. As a result of the unexpected impact, our client, who had a preexisting back injury from an earlier accident, reinjured his lower back which required surgery, and injured his right shoulder which also required surgery. Another WRSMH attorney was successful in arguing that the defendant was 100% at fault for the accident, and the court agreed, granting summary judgment against the defendant. However, because of his prior back injury, the defendant’s insurance carrier felt the injuries were unrelated to this accident and resisted making an adequate settlement offer until the eve of trial. While waiting to select a jury, Brielle was able to convince the insurance carrier to offer the entire insurance policy to settle the case.
