Serious Neck and Back Injuries
In his first Trial with the firm, Robert J. Bellinson secured a $425,000.00 recovery for our client, who had sustained neck and back injuries as a result of a car accident. Our client, who was 50 years old at the time and recently a new father, was traveling from Manhattan to Long Island and was stopped in traffic on the Queensboro Bridge when he was hit from behind by a garbage truck.
Defendants denied responsibility for the accident, claiming that plaintiff was somehow responsible, and that his injuries were not caused by this accident. The jury disagreed and, after deliberating on the issue of liability, found defendants 100% responsible for this accident.
During the damages portion of the trial Rob called plaintiff's treating Orthopedist and Neurologist. They confirmed the nature and extent of the injuries, and correlated the objective medical evidence to plaintiff's complaints of pain and discomfort. Plaintiff had multiple herniated discs at C3-C4, C4-C5, C5-C and C6-C7. The herniations were confirmed by MRI, which were introduced into evidence and enlarged to display them to the jury. Plaintiff also had an EMG, the results of which were consistent with the injuries shown to the jury on the MRI's.
On the day the jury was supposed to receive the case, prior to summations, the case settled for $425,000. Defendants had a $500,000 policy - which they were at risk for losing - and prior to the trial had offered only $15,000 to settle.
