Pedestrian Hit by Car
Wingate, Russotti, Shapiro, Moses & Halperin, LLP obtained a settlement of $200,000 on behalf of a 44 year old male client, who was struck by the defendants' vehicle after stepping into a street in the Bronx.
As a result of the car accident, our client suffered significant injuries to his back and right knee, which led to posttraumatic arthritis in his knee and would ultimately require a future knee replacement. The firm was able to negotiate a settlement at trial after our client's testimony. Our theory was that the defendants were negligent in failing to observe our client prior to impact and failed to use reasonable care under the circumstances. Given the possible exposure the defendants faced, they opted to settle the case.
