WRSMH Attorney Steve Wagner obtained a $1.8 Million verdict in Kings County Supreme Court on behalf of a 52-year-old man struck by a car in the crosswalk following a damages only trial. The plaintiff underwent a fusion of his cervical spine, lumbar endoscopic discectomy, and a shoulder arthroscopy.
Notably, the plaintiff had two previous motor vehicle accidents with an extensive history of neck and back pain and treatment. The defense radiologist and defense orthopedic surgeon both testified that the plaintiff’s condition and resultant pain were completely degenerative in nature.
The last offer to settle the case was $500,000. The plaintiff declined the offer and obtained a verdict in excess of the applicable insurance policy. The jury delivered the favorable verdict after only 30 minutes of deliberation.
