Jason Rubin settled a case for $775,000.00 involving a trip and fall in a parking lot. Plaintiff tripped and fell in a large pothole was covered with water due to heavy rain. As a result of the fall, plaintiff sustained a herniated disc in his spine, requiring fusion surgery. By using historical images from Google Maps, we were able to demonstrate that the pothole existed for several months prior to the accident and that, in the exercise of due care, the defendant should have seen the pothole and fixed it.
