82 Year Old Tripped and Fell on a Defect in Parking Lot

The plaintiff was an 82 year old female who tripped and fell on a defect in the parking lot of defendant store owner. The defect was created by defendant store owner's contractor. The plaintiff also sued the property owner.

As a result of the fall, the plaintiff sustained a fractured hip that required surgery. The plaintiff had a series of subsequent falls that the plaintiff contends was due to her compromised fractured hip from the initial fall. The plaintiff died in 2012 from leukemia. The matter settled three weeks before trial at mediation for $405,000 subject to a death compromise order.
