In a rather unusual set of facts, our client was seated on the driver’s side of a parked vehicle when she was struck by a loose rear door of a delivery truck that passed on its left. Our client refused medical treatment at the scene of the accident and began treatment shortly following the crash. As a result of the accident, she was required to undergo a cervical fusion to address her neck pain.
The defendants argued that the impact was minor and resulted in minimal property damage, that the client’s injuries were caused by a previous car accident, and that the surgeries addressed the client’s preexisting conditions and natural body deterioration.
