New York City Car Accident

WRSMH attorney Konstantin Burshteyn successfully secured a $3,000,000 settlement for our client, a 40-year-old man who suffered significant injuries to his back and left shoulder following a motor vehicle accident in New York City. The accident occurred when our client was operating a large box truck down a single-lane street in Manhattan.

The passenger was an NYPD officer who was parked in a New York City Police Department vehicle when he suddenly opened the right passenger door into the roadway. The door struck the driver’s side of our client’s wheel, causing our client’s vehicle to come to an abrupt stop. Despite the collision, our client initially refused medical treatment at the scene and continued working for the remainder of the day. However, shortly after the accident, he began experiencing pain and sought medical treatment.

The defense argued that the impact was minor and resulted in minimal property damage, that the client’s injuries were not severe, as evidenced by his initial refusal of medical treatment, and that the surgeries were due to preexisting conditions and natural body deterioration rather than the accident itself. Through extensive medical records and expert testimony, Konstantin successfully demonstrated that the City of New York was clearly liable for the accident and that the client’s injuries, lost wages, and future medical needs were directly related to the crash.
