New York Medical Malpractice
Jason Rubin obtained a settlement for $300,000 in a medical malpractice case involving the failure to diagnose a myocardial infarction in a 63-year-old woman. Decedent presented to defendant hospital with complaints of epigastric pain and pain in both arms. A cardiac workup was performed which indicated a borderline EKG and elevated cardiac enzymes. Diagnosis of gastritis. She died approximately 5 days later while alone at home.
We were able to obtain this result despite the fact that decedent's death was not witnessed, no autopsy was performed, decedent was an unemployed widow, and did not provide financial support to anyone.
