NYC Bus Accident

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Konstantin Burshteyn secured a $1,000,000 settlement for a livery cab driver who suffered serious injuries after his vehicle was struck by a New York City Transit Authority bus. Although our client initially declined treatment at the scene, he later developed significant neck, back, and knee injuries, ultimately requiring a single-level cervical fusion and knee arthroscopy.

This was a highly contested case from start to finish. Liability was heavily disputed, and our client was also sued by passengers in his vehicle who alleged he was partially at fault. The NYCTA argued that our client caused the collision and presented testimony that he changed lanes immediately before impact. After the related actions were consolidated, the Court denied summary judgment to all parties, finding that a jury would need to resolve the disputed facts.

Defendants also challenged causation and damages, relying on our client’s delay in treatment, gaps in care, and pre-existing degenerative conditions to argue that the crash did not cause his injuries or surgeries. Konstantin Burshteyn and the WRSMH team met those challenges with strong medical proof, expert support, and thorough trial preparation. After rejecting inadequate offers during multiple settlement conferences, the firm prepared the matter for trial and on the eve of jury selection obtained a $1,000,000 recovery that fairly compensated the client for his injuries.

This result reflects the WRSMH difference: we prepare every case for trial, confront difficult facts head-on, and fight relentlessly to secure the compensation our clients deserve.
