At 320 West 36th Street, New York, New York when, during the course of his employment as a carpenter’s assistant, the plaintiff was struck by a 1-foot by 3-foot plywood sheet that fell through a shaft opening from the 28th Floor to the 27th Floor deck of the building under construction, striking the plaintiff on his head.

The defendants, the owner of the premises, and the general contractor on site, failed to provide a safe place for the plaintiff to work, and failed to offer proper equipment and/or safety devices so as to prevent him from being injured at the worksite, which failure caused plaintiff's incident and resulting injuries. As a result of this incident, the plaintiff suffered injuries to his head, neck, back, shoulder and knee, and required spinal surgery and shoulder surgery.
