Wingate, Russotti, Shapiro, Moses & Halperin, LLP recently settled a case for $300,000, the full insurance policy limits, for a man who was injured when he slipped and fell on snow and ice in front of the defendant’s commercial building.
The plaintiff sought medical treatment immediately following the accident, and was diagnosed with a fractured leg and ankle, ultimately requiring an implantation of metal hardware to repair the fracture.
The firm was able to establish that the snowy and icy condition existed on the sidewalk in front of the defendant’s property for a period of time before the accident and that the sidewalk constituted a dangerous condition for pedestrians and the plaintiff.
Following depositions and discovery, the defendant tendered the full limits of the insurance policy, resulting in a successful conclusion to the case for the plaintiff.
