Douglas A. Milch, attorney at WRSMH, obtained an $800,000 settlement for his client, a then-50-year-old Manhattan construction worker who injured his shoulder and back when an overloaded wheeled container tipped, causing construction debris to strike him on the shoulder and neck. Douglas was able to obtain the settlement by establishing that the container wheels were faulty and that the container had been overloaded with steel construction debris, which should have been moved by other means. The debris caused a herniation to the client’s lumbar spine, requiring a decompressive laminectomy, and a shoulder tear requiring an arthroscopic repair.
