WRSMH attorney David M. Hoffman obtained a settlement in the amount of $1,500,000.00 for a 30-year-old construction worker who was injured in an incident at a construction site. The accident occurred in Brooklyn, New York when he slipped and fell on the staircase on the 5th floor going down to the 4th floor.
The plaintiff was performing work at the site in the course of his employment with a subcontractor to the general contractor. The plaintiff was injured when he was caused to slip and fall on a slippery and wet staircase. The plaintiff was carrying a ladder down the stairs at time of incident when he slipped on water mixed with insulation. His right hand was holding the ladder on his right shoulder. There were no handrails on the staircase. The plaintiff made prior complaints to his supervisor about this condition before the time of his accident. There was no lighting at or near the stairs. He fell to the right and his right hand got crushed between the ladder and the metal stairs.
As a result of this incident, the plaintiff suffered serious injuries to his right hand, which required two surgical procedures. David managed to successfully resolve this matter at mediation.
