David M. Hoffman, attorney with Wingate, Russotti, Shapiro, Moses & Halperin, LLP, was able to obtain a settlement in the amount of $2,600,000.00 for a 42-year-old construction worker who was injured in the course of his employment. The accident occurred on April 16, 2015, at a building/construction site located at 130 West 42nd Street, New York, at or about the 22nd floor, when the plaintiff stepped down from a window ledge onto an upside-down plastic bucket that was being used instead of a stepladder.
The unsafe bucket moved and fell over, causing the plaintiff to crash to the ground below, causing serious and permanent injuries. No safety devices were present to prevent his fall, and no ladders were made available to him to use to perform his work.
As a result of this incident, the plaintiff suffered serious injuries to his right knee, right shoulder, neck and lower back, and required spinal surgery and knee surgery.
