Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorneys Bryce Moses and Noah Katz obtained a settlement in the amount of $1,500,000 on behalf of a non-union concrete worker who sustained injuries to his shoulder and lower back that required surgery. The plaintiff was pouring concrete with a hose during the construction of a new building when the hose dislodged and struck him as it fell from above. The defendants argued that the plaintiff was warned to avoid the area before the incident occurred; Bryce and Noah countered the defendants’ argument by showing that the hose dislodged immediately, leaving no time for their client to leave the area, even if an instruction was given. The case ultimately resolved two years before reaching trial.
