Ryan J. Lawlor, attorney with Wingate, Russotti, Shapiro, Moses & Halperin, LLP, recently recovered $440,000 for a carpenter who was injured when he fell from a scaffold while on the job. As a result of the fall, the carpenter sustained an ankle fracture, causing him to miss five months of work.

The firm successfully litigated the case from inception through discovery. At the close of discovery, the court granted the firm’s motion for summary judgment on the issue of liability, finding the defendants 100% responsible for the plaintiff’s fall.

In addition, the firm successfully defended the decision before the Appellate Division, 1st Department, where it was affirmed in the plaintiff’s favor.

The matter was mediated multiple times, with the plaintiff rejecting lower, insufficient settlement offers. The plaintiff agreed to settle the matter during jury selection at a figure nearly three times the initial offer.
