WRSMH attorney David M. Hoffman was able to obtain a settlement in the amount of $1,520,000 on behalf of a 28-year-old woman from Queens. Plaintiff was involved in a motor vehicle collision on Winthrop Avenue at or near its intersection with Brook Street in Westchester County, New York. The accident occurred when plaintiff was a front seat passenger in a car operated by her friend. Plaintiff’s friend was parking her car on Winthrop Avenue when her vehicle was struck by a bus, owned and operated by the defendants, which was turning onto Winthrop Avenue and traveling at an excessive rate of speed. The defendant bus operator claimed that plaintiff’s car caused the accident by moving into the bus’s lane and striking the bus.
As a result of the collision, our client sustained serious injuries to her neck and lower back that required cervical spinal surgery. The defendants argued that the woman’s injuries were not caused by this automobile incident but, instead, were pre-existing and degenerative in nature. David overcame this argument and managed to successfully resolve the matter in mediation.
