Mediated Settlement
Our client was involved in a motor vehicle accident on the Brooklyn Queens Expressway in Brooklyn, New York. He first sought treatment for his injuries 11 days after the accident. As a result of the injuries he sustained in the accident, he underwent a minimally invasive, non anesthetized disc extrusion procedure performed at an outpatient facility. The defendant contended that the accident was 100% the plaintiff's fault, that the vehicles had no damage whatsoever as a result of the accident, the vehicles were not towed from the scene and the plaintiff was not injured as a result of the accident because he did not seek medical attention for almost two weeks.

The firm convinced the defendants that the accident was 100% the defendants fault and that the plaintiff was seriously injured as a result of the accident. During the mediation, the defendants initially offered $25,000, but due to shrewd negotiation tactics, the firm was able to convince the defendants to pay $150,000 to avoid costly litigation and a trial on the merits.
