The plaintiff was walking in the Bronx on Jerome Avenue near Clifford Place when he was struck by a truck owned and driven by the defendants.
As a result of the collision, our client sustained serious injuries to his shoulder, neck, and lower back, and required lumbar spinal surgery and arthroscopic shoulder surgery. The defendants argued that the plaintiff’s injuries were not caused by this automobile incident, but instead were pre-existing and degenerative in nature.
