Our client was a passenger in a vehicle traveling straight when it collided with a motorcycle that was making a left-hand turn. She was transported by ambulance to a nearby emergency room, where she complained of shoulder pain and was diagnosed with muscle strains, with no fractures visible on imaging. However, in the days following the crash, she began to experience significant lower back pain, eventually requiring a course of physical therapy and pain management. When this treatment failed to provide positive results, she underwent both a lumbar fusion surgery and shoulder arthroscopy.

Throughout the litigation, liability was heavily contested. Each defendant attempted to shift blame to the other and filed motions for summary judgment in an effort to dismiss the case. Konstantin successfully defeated these motions, presenting compelling evidence and testimony that demonstrated both the sedan driver and the motorcycle rider shared responsibility for the collision.

The defense also disputed the nature and cause of our client’s injuries, claiming they were pre-existing, related to a prior work injury, or the result of age-related degeneration.
