NY Ladder Fall Accident
Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Douglas A. Milch obtained a $3,000,000 settlement for an apprentice electrician who fell from a ladder and injured his neck. After discovery, we were granted summary judgment pursuant to Labor Law 240(1).
We were able to procure a substantial result even though the plaintiff did not have any surgical procedures by establishing that he needed cervical spine surgery but could not have it due to a preexisting medical condition.
Doug established through medical evidence that the plaintiff’s inability to have surgery to repair this painful herniated disc caused substantial pain and suffering in the past and would continue throughout his life. We were also able to establish through vocational experts that he was no longer employable, which added to his recoverable damages.
