WRSMH obtained a settlement in Bronx County in the amount of $500,000 for our client, a 63-year-old woman who tripped and fell on a broken step while exiting her apartment building. She was walking with the assistance of a walker (a walking frame which provides stability) at the time of the accident, lost her balance, and fell due to the cracked step.
As a result of the accident, the plaintiff suffered a fractured leg, requiring her to undergo surgery that included the implantation of hardware, and physical and occupational therapy. We were able to argue that the defective condition of the step existed for an extensive period of time before our client’s accident and that the step was repaired shortly after our client’s fall.
