Failure to Timely Diagnose Cancer of the Parotid Gland
WRSMH obtained a $750,000 settlement in a wrongful death case. Our client, a man in his late 40's, complained to the Defendant oral surgeon, about persistent facial swelling. Defendant diagnosed parotitis (infection of a salivary gland) and prescribed antibiotics and recommended hydration. We contended that the Defendant failed to timely diagnose cancer of the parotid gland, ultimately neglecting to order or recommend an MRI or CT scan. As a result, there was a delay in the diagnosis of parotid cancer, which eventually caused the decedent's death. We were able to settle before the scheduled trial date, at a mediation.
