Medical Malpractice - Surgery on Wrong Thoracic Disc Level
Jason Rubin settled a medical malpractice action during jury selection involving spinal surgery performed at the wrong disc level. Plaintiff, a 35 year old man with a herniated disc at the T9-10 disc interspace, underwent a laminectomy/discectomy procedure. Post-operatively plaintiff continued to suffer from back pain and pain radiating to his chest wall. An MRI several months later revealed that the spinal surgeon negligently operated on the T8-9 disc interspace. Plaintiff was thereafter required to undergo further discectomy procedure with fusion at the correct disc level.
