Premises Liability - Slip and Fall Injury

A WRSMH attorney obtained a settlement of $275,000.00 on behalf of a 36 year old female client who slipped and fell while descending the interior staircase of defendants’ premises.

Our client was caused to fall due to worn carpet lining on the staircase as well as a defective handrail where loose hardware caused it to detach from the wall. As a result of the accident, our client suffered significant injuries including multiple fractures to both ankles and right foot, which required surgical intervention and extensive physical therapy. Our client also sustained injuries to her lumbar spine. During a pre-trial mediation, we were able to negotiate a settlement in the amount of $275,000.00 for our client’s past and future pain and suffering. Our theory was that the defendants were negligent in failing to properly maintain the premises, and therefore failed to use reasonable care under the circumstances. Given the possible exposure the defendants faced, they opted to settle the case.
