Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorneys Cliff Shapiro and Noah Katz were successful in obtaining a settlement on behalf of their client who was struck from behind by the defendant’s vehicle. Early on during the discovery stage of the case, WRSMH was granted summary judgment with a motion filed on their client’s behalf, which found the defendant entirely responsible for the accident. The plaintiff sustained injuries to his neck and knee, which required surgery. The defendants contended that the plaintiff’s injuries were due to pre-existing conditions, but Cliff and Noah were able to demonstrate through evidence that the impact was significant based upon photographs of the damage to the vehicles, that the plaintiff had no prior injuries or symptoms of pain prior to the accident, and, as a result, the accident was the cause of his injuries. The case ultimately settled before trial.
