WRSMH attorney, William Hepner, settled this construction accident case at mediation for 2.5 million dollars. Plaintiff sustained fractures of the spine and had a surgery to repair his injuries. The accident occurred when he fell from a ladder while working on a renovation. The accident was unwitnessed. Our motion for summary judgment pursuant to Labor Law 240(1) was pending at the time of the mediation. The defendants claimed that there was nothing wrong with plaintiff’s ladder, and that he simply missed a step as he was descending. They also claimed his injuries were not as serious as asserted. Our client made a very good recovery and was capable of returning to employment, at virtually the same salary, within about a year after his accident. Given the COVID-19 pandemic, this case would not have come up for trial for at least 2 years in Brooklyn.
