WRSMH attended a mediation and settled the case of a 65 year old woman who tripped and fell on an uneven sidewalk for $199,000. Our client was leaving her daughter's home on Long Island at ten o'clock at night when she stepped off a raised slab of concrete where her daughter's walkway met the sidewalk. She had been to her daughter’s home in the past, but testified that she never left this late at night. All of the parties involved admitted there was no lighting at the point where the end of the walkway met the sidewalk, rendering it impossible to see the raised slab. As a result of her fall she suffered a facial fracture, which was repaired by ambulatory surgery a few weeks later. Our client obtained a good result from her surgery.
