$310,000 Recovery for Premises Liability

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Robert J. Bellinson obtained a recovery of $310,000 for our client who was injured at a party on Fire Island. Our client was a guest at a benefit held at a private home on Fire Island when he fell into a hole that had been cut into a deck to allow a statue to protrude out of the pool.

Our client sustained injuries to his back and leg, as well as a torn labrum in his shoulder which required surgery. Our investigation revealed that another guest had earlier fallen into the open hole, and we subpoenaed this individual to testify at our client's trial. The resolution of this case was due in large part to a WRSMH attorney who was able to establish during the discovery / deposition phase of the case that the defendants had created and permitted this dangerous condition to exist.

After jury selection was completed the defendants, the owner of the house and the contractor who constructed the deck with the hole in it, agreed to pay $310,000 to settle the case.
